Please be advised that a public meeting to consider the following applications will be held by Sarnia City Council in the Council Chambers at City Hall on: Monday, October 28, 2019 at 4:00 p.m.

Persons wishing to speak to these applications are requested to notify the City Clerk on or before noon Wednesday, October 23, 2019 in order to be placed on the agenda, although anyone in attendance will be given an opportunity to address Council on this matter.

Rezoning Application No. 7-2019-85 of 2002 was submitted by the owner, 1714792 Ontario Ltd. and the agent, Paul Weidl, Baird AE.

The subject land municipally known as 135 Water Street is located on the west side of Water Street, north of Maxwell Street.  The subject land is designated ‘Mixed Use’ in the Official Plan and zoned ‘General Commercial 3 (GC3)’ by Zoning By-law 85 of 2002.

The applicant is proposing to amend the zoning of the subject lands, to permit a 19-storey multiple use apartment dwelling with a single commercial unit and 100 dwelling units. The owner has requested the following changes to be included in a new site-specific General Commercial 3 (GC3) Zone:

Lot Area Minimum lot area of 5,500m² is required. Lot area of 2,900m².
Lot Coverage Maximum lot coverage of 35% is permitted. Lot coverage of 40%.
Planting Strip Minimum planting strip of 3m is required. Planting strip of 0m, adjacent to northern side and front lot lines.
Height Maximum height of 45m is permitted. Height of 60m.
Rear Yard Depth Minimum rear yard depth of 10m is required. Rear yard depth of 3.5m.
Side Yard Width Minimum side yard width of 21m shall be provided (6m plus ¼ building height). Side yard width of 6.4m, adjacent to north side lot line.
Side yard width of 2.7m, adjacent to south side lot line.
Parking Minimum of 1.5 parking spaces shall be provided per dwelling unit 1.22 parking spaces to be provided per dwelling unit.
Visitor Parking Minimum of 30 visitor parking spaces are required (2 spaces for every 10 required parking spaces). 21 visitor parking spaces.
Commercial Use Requirements Commercial uses may be located on the whole of the first storey. Commercial use to have minimum floor area of 58m² on the first storey.

Official Plan Amendment Application No. 16 and Rezoning Application No. 6-2019-85 of 2002 was submitted by the owner, Wendy Zenick.

The subject land municipally known as 146 Cameron Street is located on the north side of Cameron Street, west of Mitton Street North.  The subject land is designated ‘Mixed Use’ in the Official Plan and zoned ‘General Commercial 1 (GC1)’ by Zoning By-law 85 of 2002.

The applicant is proposing to amend the Official Plan and Zoning By-law to permit three (3) dwelling units to be located in a converted single detached dwelling. The owner has requested the following changes:

  1. Change the land use designation from ‘Mixed Use’ to ‘Urban Residential’; and
  2. Rezone the subject lands from a ‘General Commercial 1 (GC1)’ Zone to a site-specific ‘Urban Residential 2-55 (UR2-55)’ Zone to allow to permit three (3) dwelling units to be located in a converted single detached dwelling.

PLANNING ACT INFORMATION FOR ZONING BY-LAW AMENDMENTS

If you wish to be notified of the decision of the Council of The Corporation of the City of Sarnia on a proposed zoning by-law amendment, you must make a written request to the City Clerk.

  1. If a person or public body would otherwise have an ability to appeal the decision of the Council of The Corporation of the City of Sarnia to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Council of The Corporation of the City of Sarnia before the by-law is passed, the person or public body is not entitled to appeal the decision.
  1. If a person or public body does not make oral submissions at a public meeting or make written submissions to the Council of The Corporation of the City of Sarnia before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

OFFICIAL PLAN AMENDMENTS

  1. If you wish to be notified of the adoption of the proposed official plan amendment, or of the refusal of a request to amend the Official Plan, you must make a written request to the City of Sarnia, P. O. Box 3018, 255 Christina St. North, Sarnia, Ontario N7T 7N2.
  • If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of Sarnia before the proposed official plan amendment is adopted, the person or public body:
  • is not entitled to appeal the decision of the County of Lambton to the Local Planning Appeals Tribunal; and
  • may not be added as a party to the hearing of an appeal before the Local Planning Appeals Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
